What are the advantages of pleading fraud?

Pleading a claim in fraud has a number of advantages including the inability of the fraudulent party from being able to rely on exclusion or limitation clauses, possible removal of the corporate veil to establish personal liability, longer time to bring proceedings and greater damages.

What are the disadvantages of pleading fraud?

There is a high level of scrutiny based on companies or individuals that plead fraud, when it’s not always the only route to go. When fraud is pleaded, it can make cases more difficult to settle due to such an allegation and summary judgment may be more difficult as allegations of dishonesty will usually require cross-examination. We help you understand your options and consider what works best for your business.
