Freezing Injunction

Lincoln & Rowe have a prominent track record in the assistance of securing injunctions to freeze assets. Our litigation team acts with speed and advise on the possible risks and consequences to ensure a solution is devised and implemented. Where a freezing order is required, it is imperative to seek professional legal advice as it is a complex area of law.

What is a freezing injunction?

An injunction to freeze assets is obtained to prevent a person or company from dissipating or disposing of assets. Typically, the freezing order is to preserve a defendant’s assets and can include money held in bank accounts, land, vehicles, shares and bonds.

Under what circumstances may a court grant a freezing injunction?

Under section 37 of the Senior Courts Act 1981, the court may grant the freezing order with or without notice to the other party providing that the issue is deemed as urgent or if there is validated risk that giving notice may prompt the other party to dissipate the assets in question.

Our specialist solicitors can provide advice relating to:

  • Injunction order applications
  • Collating and obtaining evidence relating to the application
  • Duty of full and frank disclosure
  • Cross undertaking in damages
  • Getting an injunction set aside
