What is a freezing injunction?

An injunction to freeze assets is obtained to prevent a person or company from dissipating or disposing of assets. Typically, the freezing order is to preserve a defendant’s assets and can include money held in bank accounts, land, vehicles, shares and bonds.

Under what circumstances may a court grant a freezing injunction?

Under section 37 of the Senior Courts Act 1981, the court may grant the freezing order with or without notice to the other party providing that the issue is deemed as urgent or if there is validated risk that giving notice may prompt the other party to dissipate the assets in question.
